Abstract This article aims to explore some of the relationships that cross two fields of social life that Axel Honneth discusses in Freedom’s Right - families and law. To this end, makes use of a normative reconstruction, which allows to trace the general development of functionally differentiated spheres and to observe the relationships between these spheres which impact the internal realization of its normative promises. The families headed by lesbians, gays, bisexuals, transvestites and transsexuals appear here as indicators of family relationships specialization and democratization. They also appear as a paradigmatic case of the relationships between families and law.

Resumo O artigo procura explorar algumas das relações que atravessam dois dos campos da vida social investigados por Axel Honneth em O direito da liberdade: as famílias e o direito. Para tanto, lança mão da reconstrução normativa, que permite esboçar o desenvolvimento geral de esferas funcionalmente diferenciadas e observar as relações que intercorrem entre umas e outras a ponto de impactar a realização interna de suas promessas normativas. As famílias constituídas por lésbicas, gays, bissexuais, travestis e transexuais aparecem, aqui, como indicadores tanto da especialização como da democratização das relações familiares. Aparecem, também, como caso paradigmático das relações que intercorrem entre famílias e direito.

Resumo O problema que orienta essa investigação pode ser formulado da seguinte maneira: em que medida a crise constitucional, evidenciada nas reformas recentes contra o núcleo inclusivo da Constituição brasileira que compõem o programa “Uma Ponte para o Futuro”, seria também uma crise temporal? A partir de um estudo teórico-conceitual embasado em pesquisa bibliográfica e análise documental, a hipótese defendida aqui é a de que o pano de fundo dessa crise está relacionado com um discurso que instrumentaliza o “tempo histórico” e o “futuro” em si para gerar adesão social a partir da defesa aberta da aceleração, a defesa de um futuro que deve chegar mais rápido. Tal categoria é analisada a partir de uma leitura específica que esse artigo propõe da obra de Hartmut Rosa, no quadro de uma crítica à aceleração que submete os comprometimentos públicos de longa duração da Constituição à tutela da acumulação da riqueza privada e à velocidade do tempo do mercado e da competitividade.

Abstract The problem that guides the investigation can be formulated as follows: to what extent is the constitutional crisis, evidenced in the recent reforms against the inclusive nucleus of the Brazilian Constitution that make up the program “A Bridge to the Future”, would be also a temporal crisis? Based on a theoretical-conceptual study based on bibliographic research and documentary analysis, the hypothesis defended here is that the background of this crisis is related to a discourse that instrumentalizes “historical time” and “future” itself for to generate social adhesion from the open defense of acceleration, the defense of a future that must come faster. This category is analyzed based on a specific reading that this article proposes from the work of Hartmut Rosa, within the framework of a criticism to the acceleration that submits the long-term public commitments of the Constitution to the tutelage of the accumulation of private wealth and the speed of market and. Resumo: O artigo é dividido em dois blocos. O primeiro deles reconstrói criticamente, ainda que de modo provisório e aberto, o núcleo duro da gramática moderna da maternidade, ou ainda, recupera a historicidade acumulada e dissimulada da maternidade, com suas tensões e contradições. No segundo bloco, a seu passo, propõe-se uma estratégia de aliança que leva a sério o direito fundamental à licença-paternidade. Uma estratégia de aliança desse tipo, enquanto prática político-constitucional ressignificante, explicita e intervém na historicidade constitutiva da maternidade e da paternidade. E, em última instância, desdobra o projeto constituinte de sociedade, subjacente à Constituição de 1988, porque resgata os potenciais democráticos imanentes à constitucionalização da licença-paternidade.

Abstract: The article is divided into two parts. The first part critically reconstructs, although in a provisory and open way, the hard core of the modern grammar of motherhood, more particularly, recovers the accumulating and dissimulating historicity of motherhood, with its tensions and contradictions. The second block suggests a strategy of alliance that takes seriously the fundamental right to paternity leave. Such an alliance strategy, as a resignificant political-constitutional practice, makes explicit and intervenes in the constitutive historicity of motherhood and of fatherhood. And, ultimately, unfolds the constituent project of society, subjacent the Constitution of 1988, because takes back the democratic potentials immanent to the constitutionalization of paternity leave.

Resumo O presente trabalho pretende abordar de forma panorâmica o pensamento do jurista Otto Kirchheimer. Em um primeiro momento, busca-se relacionar o pensamento do jurista com a tradição da Teoria Crítica da Sociedade – conhecida também como “Escola de Frankfurt” -, cuja influência é marcante ao longo de toda sua produção acadêmica. Posteriormente, o foco residirá na crítica que Kirchheimer faz ao direito penal nacional-socialista enquanto instrumento de eliminação dos adversários políticos. Por fim, a partir da tipologia construída por Kirchheimer no texto “Justiça Política”, serão abordadas possíveis contribuições do pensamento do jurista alemão ao contexto jurídico atual.

Abstract This work aims to provide an overview of the juristic thinking of Otto Kirchheimer. At first, will be tried to relate Kirchheimer’s thought with the tradition of Critical Theory of Society - known as “Frankfurt School” - whose influence is striking throughout his academic production. Later, the focus will lie in the critic that Kirchheimer made against the National Socialist and his criminal law as instrument related to the elimination of political opponents. Finally, considering the typology built by Kirchheimer in the text “Political Justice,” will be discussed the possible contributions of his thinking in the current legal context.
